Student Rights Under Title IX and California Law
​

Pursuant to California Education Code Section 221.8, students have the right to a school environment free from discrimination, equal access to all athletic and academic programs, and the right to file a formal complaint without fear of retaliation. What is Sex Discrimination and Sex-Based Harassment?

  • Sex Discrimination: Occurs when an individual is treated less favorably based on their actual or perceived sex, gender, gender identity, gender expression, or sexual orientation in any school program or activity.

  • Sex-Based Harassment: Includes unwelcome conduct based on sex that is severe or pervasive enough to create a hostile environment, effectively denying a student equal access to the school’s education programs or activities. This includes sexual harassment, sexual assault, and harassment based on gender non-conformity

Title IX Notice of Nondiscrimination

Shade Canyon Charter School (“Charter School”) does not discriminate on the basis of sex and prohibits any acts of sex discrimination including sex-based harassment in any education program or activity that it operates, as required by California law, Title IX (20 U.S.C. § 1681 et seq.) and the Title IX regulations (34 C.F.R. Part 106), including in admission and employment.

 

Inquiries about the application of Title IX and 34 C.F.R. Part 106 may be referred to the EPS Title IX Coordinator, the Office for Civil Rights of the U.S. Department of Education, or both.

How to File a Title IX Complaint

 

  • Method of Reporting: You may report sex discrimination or harassment orally or in writing by using this form. While a formal complaint requires a physical or digital signature, you can initiate a report by simply emailing, calling, or visiting the Title IX Coordinator.

  • Timeline: Complaints should be filed as soon as possible to ensure a prompt investigation.

  • Supportive Measures: Upon receiving a report, the School will immediately offer supportive measures (such as counseling, deadline extensions, or no-contact orders) to restore or preserve equal access to education. These are available even if you choose not to file a formal complaint.

  • The Process: Once a formal complaint is filed, the School will conduct an objective investigation. Because Shade Canyon is a K-8 school, we typically use a written question-and-answer process rather than live hearings to reach a determination.

  • Standard of Evidence: The School uses the preponderance of the evidence standard (meaning it is "more likely than not" that the conduct occurred).

Bullying and Cyberbullying Prevention & Resources

Bullying can occur online through various digital platforms. Parents and students should remain vigilant regarding online interactions, which frequently occur across multiple digital forums, including:

  • Internet websites with free and easy registration

  • Platforms offering peer-to-peer instant messaging

  • Websites and applications offering public comment forums or sections

  • Apps and websites offering image or video posting platforms

Notice of Synthetic Drugs and Fentanyl Dangers 

Shade Canyon School is committed to maintaining a safe environment and keeping our school community informed of health and safety risks. In accordance with California Education Code Section 48985.5, this notice provides parents and guardians with essential information regarding the dangers of unprescribed synthetic drugs, including illicit fentanyl.

What is Fentanyl?

Fentanyl is a synthetic opioid that is up to 50 times stronger than heroin and 100 times stronger than morphine. While pharmaceutical fentanyl is prescribed by doctors for severe pain, illegally manufactured fentanyl is a primary driver of counterfeit pill distribution and accidental drug poisonings.

Key Critical Risks for Families

  • The Proliferation of Counterfeit Pills: Illicit fentanyl is frequently mixed into counterfeit or "fake" pills designed to look identical to legitimate prescription medications (such as Adderall, Xanax, OxyContin, or Percocet). A lethal dose of fentanyl is small enough to fit on the tip of a pencil, and it cannot be seen, smelled, or tasted.

  • The Role of Social Media Platforms: Criminal networks actively utilize popular social media applications and smartphone messaging platforms to market and sell synthetic drugs to youth. These networks target young demographics using emojis, coded language, and disappearing messages, often making it appear as though transactions are occurring between peers.

Classroom Water Bottle Policy

Shade Canyon School recognizes that proper hydration is essential for student health, focus, and overall well-being. In accordance with California Education Code Sections 38042 and 38043, all students, teachers, and staff have the right to bring and carry refillable water bottles to school and keep them in most classroom environments.

We highly encourage families to send students to school with reusable, spill-proof, or leak-resistant water bottles clearly labeled with the student's name. Bottles should contain water only.

Mental Health Access & Resources

At Shade Canyon School, we believe that emotional and mental well-being is foundational to learning and growth. In accordance with California Education Code Section 49428, this page provides our students, parents, and guardians with information on how to access available mental health services on campus and within our community.

How to Access Support at Shade Canyon

If you have concerns about your child’s emotional well-being, behavior, or mental health, please reach out directly to your child's classroom teacher or our school administration. Our team can partner with families to provide:

  • In-school behavioral and social-emotional check-ins.

  • Referrals to local Lake County mental health providers and community resources.

  • Coordination of support plans to ensure your child feels safe and successful in the classroom.

Charter School Notice of Student Rights

As a public charter school, Shade Canyon School is committed to providing a free, equitable, and accessible public education to all eligible students.​

Rights of Students and Families:

  • A charter school shall not discourage a pupil from enrolling or seeking to enroll in the charter school for any reason, including, but not limited to, academic performance of the pupil or because the pupil exhibits any of the characteristics described in Education Code Section 47605(d)(2)(B)(iii) (including students with disabilities, academically low-achieving students, English learners, neglected or delinquent youth, homeless or foster youth, or economically disadvantaged students).

  • A charter school shall not request a pupil’s records or require a parent, guardian, or pupil to submit the pupil’s records to the charter school before receiving enrollment approval.

  • A charter school shall not encourage a pupil currently enrolled in the charter school to disenroll from the charter school or transfer to another school for any reason, including, but not limited to, academic performance of the pupil or because the pupil exhibits any of the characteristics described in Education Code Section 47605(d)(2)(B)(iii).

 
How to File a Complaint:

If you believe that Shade Canyon School has violated any of the provisions above, or if you feel you have been discouraged from enrolling or pressured to disenroll, you have the right to file a formal complaint.

Homeless Education & McKinney-Vento Rights Notice 

Shade Canyon School is dedicated to removing educational barriers and ensuring stability for all of our students and families. Under the federal McKinney-Vento Homeless Assistance Act, students experiencing temporary housing instability or homelessness have specific rights to ensure uninterrupted access to a high-quality education.

​Who Qualifies for Support?

The McKinney-Vento Act protects any child or youth who lacks a fixed, regular, and adequate nighttime residence. This includes families living in:

  • Shared housing with friends or relatives due to economic hardship or loss of housing ("doubled-up").

  • Motels, hotels, trailer parks, or campgrounds.

  • Emergency shelters or transitional housing programs.

  • Cars, parks, public spaces, or substandard housing.

 
Your Educational Rights & Protections

Qualifying students at Shade Canyon School have the right to:

  • Immediate Enrollment: Enroll immediately in school, even if they are missing standard enrollment documents (such as immunization records, academic files, or proof of residency).

  • School Stability: Continue attending their "School of Origin" (the school they attended when permanently housed, or the school last enrolled) for the duration of the housing instability, if it is in the student's best interest.

  • Equal Access: Participate fully in all school programs, academic supports, and enrichment activities (including our tuition-free ELO-P after-school program).

  • Nutrition: Receive free school breakfast and lunch daily without a separate application.

Family Preparedness and Immigrant Student Rights

Shade Canyon School is dedicated to ensuring that every child has equal access to a safe, supportive, and high-quality public education, regardless of immigration status or citizenship. In compliance with the California Family Preparedness Plan Act, we provide the following official state resources to help families understand their educational rights and maintain family safety plans.

Know Your Educational Rights

All children living in California have a constitutional right to attend public school free of charge from transitional kindergarten through 12th grade. Shade Canyon School does not collect or request social security numbers, passports, or visa documentation during enrollment or at any other time.

Safe and Secure Learning Environment

California public school campuses are protected spaces. School personnel will not permit immigration enforcement officers to access campus grounds, student data, or student records without a valid judicial warrant or court order.

Family Emergency Preparedness Steps

We encourage all families to ensure that the school always has up-to-date emergency contacts. If you need assistance designating a trusted relative or adult caregiver to make educational or medical decisions for your child in the event of an emergency, please connect with our school administration to learn more about completing a Caregiver’s Authorization Affidavit.
